UPDATE: Just hours after the resounding approval of Proposition 50 in California, the California Republican Party has launched a federal lawsuit to challenge the redistricting measure. The lawsuit, filed on November 5, 2023, alleges that the proposition violates the 14th and 15th amendments by unconstitutionally gerrymandering congressional districts to favor one racial group.
The urgent legal action comes in the wake of a special election where Proposition 50 was overwhelmingly approved, a move seen as a significant victory for Gov. Gavin Newsom and the Democratic Party. The plaintiffs, including Republican Assemblymember David Tangipa and 18 California voters, claim the new maps unfairly benefit Hispanic voters, despite no evidence that such gerrymandering is necessary for their electoral success.
“This is a blatant attempt to manipulate electoral maps for partisan gain,” said Mike Columbo, an attorney with the Dhillon Law Group, which is representing the plaintiffs. He emphasized during a press conference that the maps drawn under Proposition 50 would diminish fair representation for other voters.
Brandon Richards, a spokesperson for Newsom, dismissed the lawsuit, stating, “If it’s from the California Republican Party and Harmeet Dhillon’s law firm, it’s going to fail. Good luck, losers.” This statement reflects the escalating tensions surrounding the redistricting process.
The lawsuit seeks an immediate injunction against the implementation of the new maps, which are crucial as candidates will begin filing to run for office in just six weeks. “Candidates must know what maps will be used for the 2026 elections,” Columbo stressed, highlighting the urgency of the situation.
In a broader context, House Speaker Mike Johnson criticized Proposition 50, labeling it a “sign of desperation” from the Democrats who, he claims, “trampled over their own independent redistricting commission.” He pointed out that with 43 out of 52 congressional districts already held by Democrats, the need for such a measure raises questions about its legitimacy.
As this story develops, voters and political analysts alike are watching closely. The outcome of this lawsuit could have far-reaching implications for California’s political landscape heading into the 2026 midterm elections.
